At-Will Employment (Florida Β§448): Florida is an at-will employment state. Unless a separate written employment agreement is executed, any W-2 employment relationship with 4D Productions may be terminated at any time by either party, with or without cause, notice, or prior warning.
Independent Contractor Classification: Many positions at 4D Productions are structured as 1099 independent contractor engagements. Contractor classification is governed by IRS Publication 15-A and Florida Department of Revenue rules. Contractors are responsible for their own self-employment taxes, general liability insurance, and equipment maintenance. 4D Productions does not withhold income tax, Social Security, or Medicare from contractor payments.
Background Check / Fair Credit Reporting Act (FCRA): By submitting this application you authorize 4D Productions to obtain a consumer report (background check) through a consumer reporting agency. Under the FCRA, you have the right to receive a copy of any report used in a hiring decision and to dispute inaccurate information. If an adverse action is taken, you will receive a pre-adverse action notice and a copy of the report. Contact information for the reporting agency will be provided at that time.
Drug-Free Workplace (Florida Β§440.102): 4D Productions participates in Florida's Drug-Free Workplace Program. All employees and contractors are subject to pre-employment and reasonable-suspicion drug testing. A positive test result, refusal to test, or adulteration of a sample may result in disqualification. Employees who test positive are entitled to request a confirmation test at their own expense. For W-2 employees, participation in an approved Employee Assistance Program (EAP) may be available.
Workers' Compensation Notice (Florida Β§440): Florida law requires workers' compensation coverage for employers with four or more employees in non-construction industries. If you are engaged as a W-2 employee, you may be entitled to workers' compensation benefits for workplace injuries. Independent contractors are generally not covered under 4D Productions' workers' compensation policy and are encouraged to obtain their own coverage.
Non-Compete Agreements (Florida Β§542.335): Florida courts enforce non-compete and non-solicitation agreements that are reasonable in time, area, and line of business. Any such agreements will be disclosed in full before you are asked to sign. You are not required to sign a non-compete agreement as a condition of applying. We comply with the FTC's Final Non-Compete Rule guidance and applicable federal guidance.
Florida Minimum Wage: Florida's minimum wage is $13.00/hr effective September 30, 2024, rising to $14.00/hr on October 1, 2025, and $15.00/hr on October 1, 2026, pursuant to Florida Amendment 2 (2020). All W-2 hourly positions will be compensated at or above the applicable minimum wage at the time of hire.
New Hire Reporting: Florida law requires employers to report all new hires and re-hires to the Florida New Hire Reporting Center within 20 days of the hire date (Florida Statutes Β§409.2576). This reporting is used for child support enforcement purposes and does not affect your application.
Record Retention: Application materials are retained for a minimum of 3 years in accordance with Florida record retention requirements. Your information will not be sold or shared with third parties outside the hiring process.
